1. HOW TO ENTER
a. The 92.3 K-ROCK YOUR ROCK MONDAY’s Contest (the “Contest”) will be on-going weekly contest starting every Tuesdaay at 12:00 am Eastern Time (“ET”) and ending each Friday at 5:30 pm ET. (Each Tuesday through Thursday period will herein be referred to as an “Entry Period.”)
b. To participate in the Contest, visit www.923krock.com during any Entry Period. Follow the links to the Contest page and fill on the online registration form with the requested information including your ten (10) song and artist ideal K-ROCK Playlist. Entries must also include your first name and last name, complete address, city, state, zip code, telephone number and a valid email address in the online entry form. Only one internet entry per person and one internet entry per email address is permitted per Entry Period. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of WXRK (the “Station”) and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the Contest. To be eligible for a specific Entry Period, all entries must be received by 5:30 pm ET on the Friday of that Entry Period. Entries will only be valid for the Entry Period in which the entry was submitted.
c. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all persons who are 18 years of age or older and who reside in the New York, New Jersey, Connecticut tri-state area. Employees of the Station, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the New York metropolitan area and the members of their immediate families and those living in the same household are ineligible to participate or win.
b. Only one winner per household is permitted in any Station contest. Entrants are eligible to win a WXRK sweepstakes only once every sixty (60) days. Entrants are eligible to win a prize valued at $600.00 or more only once every six (6) months.
c. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. PRIZES
a. One (1) Grand Prize per Entry Period. The Grand Prize will change each Entry Period and will be announced. The Grand Prize for the Entry Period beginning May 12, 2008 will be one (1) trip for two to Los Angeles, California. Trip includes: roundtrip coach airfare, one night hotel accommodations in a standard double occupancy room at a hotel of the Station’s choosing, ground transportation, access to the Nine Inch Nails Pre-Tour Band rehearsal and after-party movie screening at the Hollywood Cemetery. Travel Dates: July 19, 2008 – July 20, 2008 (Approximate retail value: $1,500.00). Winner must be able to travel on specified dates or prize will be forfeited and an alternate winner may be selected from a random drawing of all remaining qualifiers. Travel companions of winner must travel with winner on the same travel itinerary. Travel companion of the prizewinner must be 21 years of age or older. Winner and travel companion are solely responsible for obtaining travel insurance (and all forms of insurance) where applicable, at their option, and hereby acknowledge that the Station has not and will not obtain or provide travel insurance or any other form of insurance. Any winners of certificates/vouchers will be subject to the terms and conditions as set forth by the provider of the certificate/voucher. Grand prize winner and travel companion are solely responsible for all applicable taxes including but not limited to hotel, hospitality and airport taxes, telephone charges, meals, gratuities, ground transportation and any other expenses not specifically offered herein. Grand prize winner may be required to present a valid credit card upon hotel check-in to cover incidental expenses incurred during stay. Other restrictions may apply. All travelers must possess required travel documents (e.g. valid photo I.D.) prior to departure.
b. Five (5) Qualifying Prizes per Entry Period. Each Qualifying Prize winner will receive one (1) pair of tickets to see Nine Inch Nails perform at the IZOD Center in East Rutherford, NJ on August 27, 2008. (Approximate Retail value: $130.00 each pair of tickets).
c. All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within ten (10) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
d. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of Station management with respect to the Contest are final.
b. On Friday at approximately 6:00 pm ET following each Entry Period, the Station, in its sole and absolute discretion, will select the best thirty-one (31) playlists from among all playlists received during that Entry Period (the “Selected Playlists”). The Station will contact the listeners whose entries have been selected as the Selected Playlists. Selected Playlist Winners will not receive a prize. However, their playlists will air on the Station (the Station will notify each Selected Playlist winner when his/her playlist will air on the Station) and Selected Playlists Winners will be given the option to introduce their playlists on the air. The Station reserves the right to switch out any song in a Selected Playlist when it airs the playlist.
c. After the Selected Playlist Winners have been selected, the Station, in its sole and absolute discretion, will then select the five (5) best playlists from among the Selected Playlists (the “Qualifying Playlists”). The five (5) Qualifying Playlist winners will each receive a Qualifying Prize.
d. Beginning each Monday at approximately 12:00 am ET following an Entry Period and ending the following Sunday at approximately 11:59 pm ET, the Qualifying Playlists selected during that Entry Period will be listed on www.923krock.com (the “Voting Period”). During the Voting Period, Station listeners will vote on that Entry Period’s best Qualifying Playlist. The Qualifying Playlist that receives the most votes will be considered the Winning Playlist and the listener that submitted the list will receive the Grand Prize. Only one vote per person and per IP address, please. All votes must be received by 11:59 pm ET at the end of each Voting Period.
e. In the event of a tie, the best of the tied playlists, as determined by the Station in its sole and absolute discretion, will select as the Grand Prize Winner.
f. Winners will be notified via email and/or phone.
g. Winners do not need to be present to win.
h. Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within ten (10) days of notification attempt or prize will be forfeited and an alternate winner may be chosen by random selection.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
d. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry or voting process, the operation of the Station’s Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement.
f. Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
h. Copies of the written Contest rules and a list of winners (when complete) are available during regular business hours at the main studio of WXRK, 40 West 57th Street, New York, NY 10019.
