Contest Dates:
The Opie and Anthony and All American Ford Mustang Giveaway Contest (the “Contest”) will be conducted Monday through Friday between the hours of 6:00 am Eastern Time (ET) and 9:00 am ET beginning on 7/22/2008 and ending on 8/1/2008 (the “Contest Period”).
How to Enter the Contest:
Listen to 92.3 K-ROCK (the “Station”) during the Contest Period for the on-air announcement or cue to enter (“Cue”). Opie and Anthony will announce the Cue to text in for a chance to win one of eighteen (18) Qualifying Prizes – a pair of tickets to the Opie and Anthony Traveling Virus and a chance to win a Ford Mustang. Listeners may enter as follows:
1. TEXT MESSAGING ENTRY: Upon hearing the Cue, Listeners must text the keyword announced on air to 69923 for a chance to win a Qualifying Prize. The Station is not responsible for telephone service outages, delays, equipment malfunctions and any other technological difficulties that may prevent an individual from sending a text message. Standard text messaging fees may apply and the Station is not responsible for any fees incurred by a participant using this method of entry.
2. ONLINE SHORTCODE ENTRY: To enter for free upon hearing the Cue, visit www.textrules.com/altentry, and complete and submit the online entry form with the requested information, including your name and telephone number for a chance to win a Qualifying Prize. Listeners MUST Enter 69923 in the Shortcode field and enter the keyword announced on-air in the “Contest Keyword” field. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
The entrant who submits the 92nd entry following the Cue will win a Qualifying Prize – a pair of tickets to see the Opie and Anthony Traveling Virus and a chance to win a Ford Mustang pending verification of eligibility and compliance with these official rules. Up to two (2) potential Qualifying Prize winners will be selected each weekday during the Contest Period. Odds depend on the order and number of text message or short code entries received. A maximum of eighteen (18) potential Qualifying Prize winners will be selected during the Contest Period by the first two methods listed above. Prior to each Cue, the Station, in its sole and absolute discretion, will announce which specific tickets (seats) are being awarded. There is no limit to the number of times a listener may attempt to win via the above referenced methods, but a listener may only win one Qualifying Prize.
In addition, listeners will also have a chance to win one of two (2) additional Qualifying Prizes by registering online at www.allamericanford.com between 12:00 am ET on 7/22/2008 and 9:00 am ET beginning on 8/1/2008. Simply follow the links and instructions to enter and submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth, and a valid email address in the online entry form. Only one internet entry per person and one internet entry per email address is permitted. Two potential (2) Qualifying Prize winners will be selected in a random drawing by the Station on or around 8/1/2008. Odds depend on the number of entries received. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property the Station and the Sponsor and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by the Sponsor. The Sponsor’s computer is the official time keeping device for the internet entries for the Contest.
A maximum of one (1) Qualifying Prize will be awarded per household.
Eligibility:
The contest is open to all persons who are 18 years of age or older and who reside in New York, New Jersey or Connecticut. Employees of All American Ford, Inc., (the “Sponsor”), the Opie and Anthony Show, WXRK (the “Station”), its licensee, and each of their parent, subsidiary, and affiliated entities, (collectively, the “Released Parties”) their advertising agencies, participating sponsors/promotional partners, other radio stations in the New York metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. Listeners may win a prize in a Station-conducted contest once every 60 days. Only one winner per household is permitted in any station Contest. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will also disqualify any entry from individuals who do not meet the eligibility requirements, and the station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act. The winner of the Grand Prize must possess a valid driver’ s license and must have proof of or be able to obtain automobile liability insurance and any other state automobile insurance requirements prior to taking possession of the vehicle prize.
Prizes:
Twenty (20) Qualifying Prizes: a maximum of twenty (20) Qualifying Prizes, including two (2) pairs of tickets to the Opie and Anthony Traveling Virus will be awarded. Approximate Retail Value (“ARV”): $50.00 per Qualifying Prize. In addition, each Qualifying Prize winner will be invited to the “key turning event” on August 2, 2008 at which each will have the chance to win the Grand Prize Mustang as described below. Tickets to the Opie and Anthony Virus must be picked up at the PNC Bank Arts Center on August 2, 2008 prior to the show.
One (1) Grand Prize: a 2008 Ford Mustang GT Coupe. ARV: $30,680.00. The winner of the 2008 Mustang will be subject to the terms and conditions as set forth by the provider of the vehicle. Winner will be solely responsible for all car title, tax, tags, proof of insurance and license and registration fees, emissions inspection, freight, delivery, dealer prep, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, all other fees and expenses not specified herein associated with the receipt and use of this prize vehicle. Winner must provide proof of insurance and a valid driver’s license and must take delivery at the dealership and time specified by the Station and Sponsor. The winner will accept the chosen prize vehicle "as is." Released Parties accept no responsibility for repairing any real or supposed damage to the prize vehicle from this contest. If the grand prize is not available at the end of the contest, including vehicle color, a substitution of equal value will be made solely at the discretion of the Station. Neither the Station nor the Sponsor have made or are responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the grand prize vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the vehicle. Any additional vehicle options (including the interior and exterior color of the prize) not specified herein is subject to availability and will be the responsibility of the winner. In the event that the grand prize winner is not able to obtain valid automobile insurance or does not hold a valid driver’s license, the winner will forfeit the prize vehicle and will not be awarded a cash alternative. Details for the delivery or pick-up of the Grand Prize will be facilitated between the winner and the dealership with the assistance of Station staff.
There is no substitution, transfer or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the items listed above and do not include any taxes, gratuities or any other expenses. Other restrictions may apply.
Grand Prize Winner Selection:
All twenty (20) Qualifying Prize Winners as determined above will be invited to the Grand Prize “Key Event” to be held on Saturday, August 2, 2008 at a time to be determined and announced on-air. The Grand Prize “Key Event” will be held at the Opie and Anthony Traveling Virus event at the PNC Bank Arts Center in Holmdel, NJ. All Qualifying Prize winners must sign in and register prior to the start time of the Grand Prize Key Event. At the time of sign in and registration, all entrants will be required to provide government-issued photo identification to confirm identity and will be required to provide to the Station their first name, last name, complete address, city, state, zip code, telephone number, date of birth, and valid email address. The Qualifying Prize winners arriving after the Grand Prize Key Event start time or those failing to sign in as described above will be disqualified from participating. As Qualifying Prize winners sign in, Qualifying Prize winners will be given a randomly selected number, which will be used to determine the order of when the Qualifying Prize winner will be called on stage to attempt to start the car. After all Qualifying Prize winners have been given their numbers, the numbers will be placed into a container where they will be drawn randomly, one by one, by a WXRK host. As the numbers are drawn, the Qualifying Prize winner whose number is announced will come forward and randomly select one (1) vehicle key out a large bin. Once the key has selected, the Qualifying Prizewinner will then attempt to start the vehicle. The first Qualifying Prize winner who is able to start the vehicle with his or her key shall be determined to be the Grand Prize winner, pending verification of eligibility and compliance with the official rules. Once a key starts the engine of the Mustang, the contest will be over, and no other Qualifying Prize winners will have an opportunity to attempt to start the Grand Prize vehicle. Odds of a Qualifying Prizewinner winning the Grand Prize are approximately 1:20.
Decisions of station management with respect to the contest are final. Grand prize winner must be present to win. No proxies will be permitted. Any Qualifying Prize winner who is not present at the Grand Prize Key Event as of the deadline for filing will forfeit his chance to win the Grand Prize.
If for any reason the operative key fails to start the vehicle, the station will randomly select one Grand Prize Winner from among all registered Qualifying Prize winners at the grand prize key event.
Prize Conditions:
Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within ten (10) days of notification attempt or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
General Conditions:
Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. Prior to awarding any prize or prize certificate, the Released Parties in their sole discretion may require contest winners to sign a liability release, agreeing to hold the Released Parties, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s website or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the sweepstakes if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the sweepstakes and shall not be required to award a substitute prize. Failure to comply with the sweepstakes rules may result in an entrant’s disqualification solely at the discretion of the Station. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the sweepstakes, or in the announcement of a prize.
