March Bracket Brawl Rules

1. HOW TO ENTER

a.    The WXRK “March Bracket Brawl Tournament of Rock” promotion (the “Contest”) will begin on March 5, 2008 and end on March 31, 2008 (the “Contest Period”). Blank brackets of 64 bands will be placed on-line and www.923krock.com. WXRK listeners 21 or older can fill out a bracket picking which bands they think will advance to the next rounds and move on to champion. Bands will move on according to how many text votes and online votes they receive when the Station solicits votes and plays the Bracket of Bands Back to Back on-air. All brackets must be filled out online and submitted by Monday, March 10, 2008 at 10:00 am Eastern Time (“ET”). Points will be awarded for each correct pick.   The submitted bracket with the highest point total at the end of the Contest Period will be declared the grand prize, after proof of eligibility. In the event of a tie, all eligible contestants with the highest point total at the end of the Contest Period will go into a drawing and one person will be chosen at random as the grand prize winner. Brackets must be submitted by 10:00 am ET on March 10, 2008.

b.    ONLINE REGISTRATION: To participate in the Contest, you may enter via the following method(s): Go to www.923krock.com and go to the Contest page during the Entry Period. Listeners must fill out the online entry form with their first name and last name, complete address, city, state, ZIP code, date of birth, home telephone number, and a valid email address in the online entry form. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. For purposes of these Official Rules, “receipt” of an online registration will be solely determined when the www.923krock.com web server records the entry information. Any automated computer receipt (such as one confirming delivery of e-mail) does not constitute actual receipt of a membership form for purposes of these Official Rules. Use of any device to automate entry is prohibited. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches. The WXRK computer servers will serve as the official timekeeper for the Contest. All brackets must be filled out online only.

c.    Matches will take place Monday though Friday during the Contest Period at about 10:00am ET, 1:00pm ET, 4:00pm ET and 7:00pm ET beginning March 10th, 2008 and ending March 31st, 2008. Two songs will be played from each band and listener votes decide the winner. You are voting for which band you want to win. Text in your vote to the number 69923. Text “a” to vote for the first band played, text “b” to vote for the second band played. Votes will be taken from when the first song starts to when the last song ends. You may vote for either band at any time during their respective match. Listeners will also be able to vote online at www.923krock.com.   Listeners do not need to sign up to vote. Online voting will occur through online polling where listeners can click on the band he or she wishes to vote for. There will be a limit of one vote per match-up.

Championship- 20 Points For Each Correct Pick
You will receive 25 Bonus Points for picking the correct two bands to play in the Championship
You will receive 50 Bonus Points for picking the overall Champion

2. ELIGIBILITY RESTRICTIONS

a.    The Contest is open to legal residents of the US who are 21 years or older and reside in the New York Tri-State area through the registration methods outlined above. Employees of WXRK (the “Station”), CBS Radio, CBS Radio sponsors, other New York area radio stations, their affiliates, subsidiaries, distributors and advertising, promotional or judging agencies and immediate family members of such employees are not eligible to enter and win. “Immediate Family” includes spouses, parents, brothers, brothers-in-law, sisters, sisters-in-law, children, persons who live in the same household, grandparents, step-parents, half-brothers, step-sisters, half-sisters, step-children and grandchildren. No groups, clubs or organizations may participate in this offer or reproduce or distribute any portion of these rules to its members.

b.    Listeners are eligible to win a Station contest only once every sixty (60) days and a prize valued over $600.00 or more only once every six (6) months. Only one winner per household is permitted in any Station contest.

c.    Winners must sign a participant release and hold valid government issued photo identification.

d.    Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3.    PRIZES

a.    One (1) On-Line Bracket Grand Prize will be awarded. The Grand Prize is (1) Mitsubishi 73inch 108p DLP HDTV. Approximate Retail Value: $4,000.00.

b.    All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within forty-five (45) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.

c.    There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a.    Decisions of Station management with respect to the Contest are final.

b.    The one (1) eligible contestant with the highest point total will win the Grand Prize. In the event of a tie, all eligible contestants with the highest point totals will go into a random drawing and one (1) person will be chose at random as the Grand Prize winner.

c.    The grand prize winners will be notified by WXRK Marketing & Promotions Department on or after March 31st, 2008.

d.    Odds of winning depend upon the number of eligible entries received via on-line entry.

e.    Winner does not need to listen or be present to win.

f.    Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within ten (10) days of notification attempt or prize will be forfeited and an alternate winner may be chosen by random drawing from all eligible brackets.

5. CONDITIONS

a.    Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.

b.    By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c.    Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners (and their guests, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.

d.    The Station, in is sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

e.    The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.

f.    Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Station.

g.    The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.

h.    Copies of the written Contest rules and a list of winners (when complete) are available during regular business hours at the main studio of WXRK, 40 West 57th Street, 14th Floor, New York, NY 10019.

6.    INTERNET SWEEPSTAKES PRIVACY POLICY

a.    By use of this website and by entering the Contest, you agree to the Station’s Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: www.923krock.com.
